Article 35.

Trade Jurisdiction

Section 1. The Agency retains the basic right to assign work and the Union acknowledges said right. The Agency shall endeavor when exercising said right upon bargaining unit employees to insure that the duties are accurately reflected by current position descriptions.

Section 2. Employees who perform duties outside their position description shall receive proper orientation or training (including OJT), as appropriate, to allow them a fair opportunity to perform the duties safely and achieve the highest level of performance for the Agency.

Section 3. The Agency will not assign duties which would normally be considered as outside the position description in a punitive or disparate manner. Such duties will normally be rotated among the various employees on a particular work project or tour of duty.

Section 4. Employees will normally work within the scope of their position description. Occasionally, employees may be required to perform duties which are beyond the scope of the position description. Management will endeavor to limit these occurrences to a minimum and evenly distributing these duties between all qualified employees.
